Visitors' activities are legalized through official employment, obtaining a business visa and a work Permit. The company, in turn, must comply with quotas: for each foreign employee, it is necessary to hire several Thais (usually 4-5).
What is subject to regulation? Regulates the activities of companies (legal entities) in general. A real estate agency must be registered in accordance with Thai law, have a tax number, and the relevant type of activity must be indicated in the registration documents (analogous to OKVED) - the right to conduct real estate transactions. Low expertise and "one-day deals."An agent may only know a couple of hyped projects, have a poor understanding of the law, or simply leave the country, abandoning you halfway through the deal. - The agency does not have an office, and the meeting takes place in a cafe.
- There is no information about the owners/management of the company.
- Pressure on urgency ("price only today!»).
- Please transfer money to an individual's personal account, especially abroad.
- Refusal to provide a detailed step-by-step plan of the transaction and contacts for direct communication with a lawyer or developer.
- Absence of an agent in the company's registry on the website, data inconsistency.
What should a reliable agent and agency have?: verification instructions

For an agency (company):
1. Official registration.The company must have a Thai Tax ID. It is possible (and necessary!) check in the open register of companies in Thailand (website of the Ministry of Commerce, requires knowledge of Thai or the help of an interpreter). 2. Having an office. A physical office is a sign of seriousness. It's worth going there in person or at least checking through online maps.

4. Transparency of the structure.Information about owners and key managers should be publicly available.
For the agent (your personal manager):
1. Work Visa and Work Permit ABSOLUTELY.This is the main document confirming the legal right to work in Thailand for this particular company. Do not hesitate to ask to see the documents. Without them, a person is in the country illegally, and there are no guarantees of his responsibility.
2. Experience and depth of knowledge.The agent should know the specific market well (Phuket, Pattaya, Bangkok are very different), the history of developers, the legal nuances of transactions with foreigners, and the processes in the Land Resources Management (Land Office).
3. Teamwork. A good agent doesn't work alone. It is backed by a company with Thai employees (who can officially conduct the screenings), as well as a full-time or partner lawyer, and an after-sales service department.
4. Involvement in the professional community.The participation of an agent or agency in broker alliances (for example, in the Phuket Broker Alliance), regular meetings to exchange information about developers and the market are a sign of professionalism and focus on long-term work.

Where to complain in case of problems?
If you encounter fraud (theft of money, forgery of documents), there is only one way to go to the police and then to court.
If the problem is negligence or incompetence, there is often no legal leverage, as there is usually no written agreement between you and the agent.;(the developer pays the agent's commission, not you). Therefore, all your protection is based on reputational mechanisms: complaints to professional alliances (if the agent is a member of them), publication of honest reviews, and contacting the Thai Real Estate Association.
