Inheritance of real estate by children
Victor Gavrilov asks:
Good morning! Is it enough to draw up TAPU for yourself and the children so that the children have the right to inherit property. How, then, is property inherited? Children are included in TAPU.

Hello Victor!
Unfortunately this will not be enough. Given that children are brought to Tapu, they will always have the right to their shares indicated in Tapu. However, the right to your share, if necessary, they will need to confirm additionally.
I give you an excerpt from our answers on the question of inheritance, which can help you:
The inheritance of real estate in Turkey, which is registered as a foreign citizen, takes into account the laws of the country of which the owner of the real estate is a citizen. Thus, a will that a foreign citizen can leave in Turkey on his property here cannot fully ensure the transfer of property to the person he indicated in the will - this will not be enough.
If necessary, the heirs of the property owner must submit to the judicial authorities of Turkey a document on the inheritance from their country - that is, a certificate of inheritance right, where the heirs of the property owner are clearly registered.
It is on the basis of this most important document that the heirs can appeal to a Turkish court, which will decide on a change of ownership. Based on this decision, the Office of the Cadastre and Tapu will re-register Tapu as heirs.
In this matter, it is better to contact a lawyer who will help you through all the necessary procedures.
Once again I want to emphasize that only a will, which the owner can leave in Turkey, alone will not be a sufficient basis for the transfer of property rights.

Hello Victor! If the children are brought to Tapu they are also already owners regardless of whether they are relatives to you or not! The property belongs in equal shares to all owners inscribed in TAPU

Turkey has simple and transparent legislation regarding property inheritance. Heirs of the first degree - spouse and children. The spouse receives 25% of the inheritance, the remaining 75% are divided equally between the children. If there are no children, then the spouse receives 50% of the inheritance, the second half is received by the parents of the deceased.
The right to inherit comes into force from the day of the death of the testator, however, the deadline for submitting an application for the right to inherit real estate in Turkey is 10 years. The presence of heirs of Turkish citizenship, residence permit, place of their current residence does not matter. Foreign citizens to go through the inheritance procedure and in order to prove that they are heirs must apply to a Turkish court and provide documents confirming kinship there. After receiving a certificate of inheritance from a Turkish court, they must contact the tax and cadastral services. Of course, all these steps must be taken with a lawyer.

TURKEY. Taxes, fees
Good afternoon! Please tell me if there is any tax for making changes to the Tapu, a new surname in the passport. In this case, I don't need a Tapu translator, but as a foreigner, I was forced to buy and sell. Is it necessary to simply change the last name in the document? What else do I have to pay? Tax or fee. I can't find any information on this topic at all. Thank you in advance for your reply! Sincerely, Ksenia.

Hello! How do I pay for an ID from another country? I'm not in Turkey right now. Should the management company issue an invoice for payment? The bank did not accept our payment, as they require an invoice for services to be paid to a legal entity. And we also don't know how to pay the tax remotely. Thank you in advance for your reply!
