Good afternoon. My mother wants to donate real estate (apartment and garage) to me (son). which she has in Montenegro (Becici). She herself cannot travel to Montenegro due to her advanced age and lack of a foreign passport. I can only come myself. Tell me what documents we need to prepare for the real estate reissue.

What needs to be prepared for making a donation agreement:
1/ If mom has a spouse, then you need his notarized consent to make a donation transaction. If your mother is unmarried, then you need proof of marital status (divorced/widowed).
2/ Your birth certificate to confirm the close relationship.
3/ Document translations (into Montenegrin - can be translated in Montenegro by a court interpreter).

And a caveat: the notary recommended that the authorized representative of the donor and the donee should not be the same person.

1. If the donor cannot attend the signing of the donation agreement in person, it is necessary to prepare a notarized power of attorney for signing such an agreement for someone who can be present in person in Montenegro.
2. If the donor is married, consent from the spouse is required. Or proof that the person who is going to donate the property is unmarried. For this purpose, copies of all pages of the internal passport will be suitable. Some notaries may request notarized copies of the internal passport with a translation.
3. A notarized copy of the birth certificate with a judicial translation. Also, do not forget that for some countries Montenegro requests copies of documents with an apostille (for documents from Russia, an apostille is not required).
4. The notary may also require a contract of sale of the property when the donor purchased it.

The power of attorney is signed by the Donor and the Donee. Since you are a Gifted Person, your mother must give a power of attorney to the Donor, and it must be someone else, you cannot give this property to yourself. You can get a power of attorney from your mother from a Russian notary with all the details of the property. Here, on the spot in Montenegro, it will be possible to make an official translation into Russian. And you need the consent of the mother's spouse to donate if she has a spouse. Notaries also usually require a copy of the old purchase agreement, on the basis of which the property was purchased, and a copy of the old passport, according to which the property was issued.
