Lawyers call the program legally questionable: it does not have Congressional approval, it can be canceled by presidential decree at any time, and it is almost guaranteed to lead to lawsuits. Michael Wilds (representing Melania Trump and her parents) told the newspaper that he refuses to conduct such cases, as it would be "unethical".
According to WP, out of 338 applications submitted for a "gold card", only 165 people paid a non-refundable fee of $ 15,000, and 59 reached the next stage. At the same time, as follows from the court documents, holders of a gold card do not receive priority over applicants for EB-1 and EB-2 visas (for outstanding talents), contrary to initial promises.
Lawyers compile comparative tables for clients. An EB-5 verified visa (investment of $800,000) allows the spouse and children of the main applicant to receive a green card and cannot be revoked by decree. The Golden Card (1 million + 1 million dollars for each family member) does not have a strict legal framework. As lawyer Ron Klasco told WP, after such a comparison, clients usually choose EB-5.
The executive director of the Invest In the USA industry association told The Washington Post that in a professional environment, the "golden card" is discussed only informally, and serious conversations are not conducted. Some lawyers are even wary of consulting on this program because of the risks to their own reputation.
