New Polish asylum law will affect the real estate market

Starting in 2026, infrastructure security will become a key factor for investors in the Polish real estate market. Although the so-called "asylum law" has been formally in force since 2025, its real impact on investment practices is just beginning.

The Law creates a legal framework for the planning and use of civil defense facilities, such as shelters and temporary residence zones. Now, many new residential and commercial buildings, especially those with underground floors, must be designed with protective functions in mind. The new regulations will primarily affect projects whose construction permits will be obtained after December 31, 2025.

What are the implications for the market?

The main immediate effect will be an increase in the cost of projects due to the need to strengthen structures, install improved ventilation and safety systems. This can lead to higher rental and sale prices, as well as more informed investment decisions.

Over time, buildings offering an increased level of security may stand out in the market. This will be a special advantage in the premium segment and for strategic locations.

Thus, the law will not only increase the requirements for construction, but may also reallocate the priorities of both developers and buyers, making security a new significant characteristic of real estate.
