Reporting on foreign accounts Russians is being postponed

Today, Russian citizens are not required to report to the Federal Tax Service of the flow of funds on the accounts in foreign banks, as the government has not yet approved the official reporting form, according to RBC.

According to the amendments to the law "On Currency Regulation and Currency Control", adopted in July last year, with January 1, 2015 Russian citizens who have accounts and deposits in foreign banks must submit to the tax authorities at the place of registration records of the flow of funds on these accounts.

By 2015, report foreign bank accounts and cash flow on it were only legal entities and individual entrepreneurs. As of claim 7 gl.12 law, notification must be made in the order established by the federal government. The procedure and the notification form for companies and entrepreneurs the government adopted in 2005.

Last fall, the Finance Ministry has developed and posted for public discussion of draft amendments to the rules of notification and report form to spread their effect on individuals. FTS representative told RBC that as of April 30 report form and the procedure for its submission has not yet been approved.

"Given the above, individuals - residents have the right to provide information about the flow of funds on accounts in banks outside the Russian tax authorities, however, a duty to the approval of the form and order of presentation by government decree does not occur", - said the representative of the Federal Tax Service.

Nevertheless, the tax authorities in Moscow have already started to send the requirement to submit reports by individuals on the movement of funds in foreign accounts - with an indication of the period of compulsory personal filing until 30 April 2015. However, since the relevant government documents submission process is not yet established such requirements of the tax authorities to the approval of the relevant government order "are not binding and may be regarded as newsletters," said RBC representative of the Federal Tax Service.

He denied reports that such letters are sent en masse. "About any mass distribution of such requirements is not speech, but there are special cases of a number of directions of the tax authorities", - the official said, without specifying whether it is a question only of the letters of the INFS ¹22 in Moscow.

If the decision to include rules on the movement of funds of natural persons of the report will be made this year, the first report will need to apply until 30 January 2016, said RBC partner Paragon Advice Group Alexander Zakharov.
