According to the package of judicial reform measures being developed, real estate transactions, the amount of which exceeds the threshold set by the state, will require the mandatory participation of a lawyer. The specialist will have to be present at the registration of the transaction with the land Registry authorities (Tapu).
The authorities are pursuing several goals at once:
1. Anti-fraud.Professional control will help minimize the risks of fraud and procedural errors during purchase and sale.
2. Reducing the number of disputes.Legal expertise at the contract conclusion stage is designed to eliminate ambiguity and prevent future litigation between buyers and sellers.
3. Protection of citizens.The reform is aimed at increasing legal certainty and security for participants in complex and expensive transactions.
"This requirement will help to increase the legal security of real estate transactions," Gurlek emphasized.
The Minister also noted that the initiative would not only protect buyers, but also open up new professional horizons for Turkish lawyers, expanding their field of activity.
At the moment, the Ministry of Justice has instructed the relevant departments to begin developing a regulatory framework that will determine the exact threshold for the value of the transaction and the rules for the participation of defenders.
